How Fatwas Are Issued: Process and Qualifications

Producing a reliable fatwa is a structured process that depends on the training of the scholar involved and the sources they are able to draw on. This page outlines the general steps and requirements involved, without reference to any single institution.

01

1. The Question Is Received

The process begins when someone, known as the mustafti, poses a specific question to a scholar or a panel of scholars. The question may relate to worship, business dealings, family matters, food, medicine, or newer areas such as digital finance. The way the question is phrased matters, because a fatwa is generally understood to apply to the precise circumstances described.

02

2. The Scholar's Qualifications

A scholar capable of issuing a sound fatwa, referred to as a mufti, is expected to have extensive training that typically includes:

  • Memorisation and detailed study of the Quran
  • Study of Hadith, the recorded sayings and actions of the Prophet Muhammad, including how reliable each narration is considered to be
  • Study of Arabic language and grammar, since the primary sources are in Arabic
  • Study of usul al fiqh, the principles and methodology of Islamic legal reasoning
  • Familiarity with the rulings of earlier scholars within one or more schools of thought

This training is usually acquired over many years through formal study at a recognised Islamic seminary or under the supervision of established scholars.

03

3. Research Into the Sources

Once a question is understood, the scholar researches how the matter has been addressed in the Quran, the Sunnah, and the body of earlier scholarly opinion. Where a situation is new, such as a modern financial instrument or a medical procedure that did not exist in earlier centuries, the scholar applies established principles of reasoning, including analogy with similar, previously addressed cases.

04

4. Consideration of Context

A careful fatwa takes into account the specific circumstances of the person asking, as well as broader considerations such as necessity, hardship, and the intention behind an action. This is why fatwas on seemingly similar topics can differ depending on small but legally significant details in the question.

05

5. Individual or Collective Rulings

Some fatwas are issued by a single qualified scholar. Others go through a collective process, where a panel or council of scholars discusses the question and reaches a joint position. Collective fatwas are often used for matters of wide public interest, such as questions affecting an entire community or involving complex modern topics like digital currencies or new medical technologies, since a panel can draw on a broader range of expertise.

06

Fatwa Compared to a Court Judgment

A fatwa is different from a judicial ruling, known as a qada, which is issued by a judge, or qadi, within a formal legal system and is generally binding on the parties involved. A fatwa, by contrast, is an opinion intended to inform and guide a person's conduct according to their own understanding and conscience. In some contexts, however, individuals or institutions choose to treat certain fatwas as binding for internal purposes, such as within an organisation that has agreed to follow a particular scholar's guidance.

07

Why the Process Matters

Understanding this process helps explain why not every opinion shared casually, including on social media or informal online forums, carries the same weight as a fatwa produced through the training and research outlined above. When a decision is important, scholars generally recommend seeking a ruling directly from a recognised and qualified source rather than relying on secondhand summaries.
